Preamble

The online store THE PINK ARTIST accessible at the following address: www.thepinkartistparis.com (the "Site"), is an e-commerce website accessible via the Internet network, open to any user of this network. It is published by the company ATELIER MIGNON ("We", "Our", or "Us") whose contact details and social identity are accessible at all times:

General Provisions

These general terms and conditions of sale (the "General Sales Conditions") apply to the offer and sale of products on the THE PINK ARTIST Site in the European Economic Area ("EEA").

In order to be eligible to purchase products on the Site, customers must: (a) be at least 18 years old or, in the case of minors, be duly authorized by their legal representative; (b) have the status of consumer, meaning acting as a natural person for purposes outside any commercial, industrial, artisanal, or liberal activity, and (c) have a valid debit or credit card.

This contract will be executed in the language of the country where your delivery address is located and will be governed by the laws of that country (the "Country"). You can consult the list of countries and their corresponding applicable laws by clicking here. These laws are referred to as "local laws" in these terms of sale.

Before placing an order for a product on the Service or through the Customer Service, customers are invited to expressly accept these General Sales Conditions. Customers may save or print these General Sales Conditions, also available at any time on the Site. These General Sales Conditions may be modified from time to time.

The General Sales Conditions applicable to an order are the Conditions published on the Site at the time the customer places the order. In accordance with applicable electronic signature laws, placing an order as detailed below is considered an electronic signature and proof of the order and the amount due.

By checking the corresponding boxes during the order or registration process on the Site, you acknowledge that you have read, understood, and accept, without restriction or reservation, these General Sales Conditions, as well as our Site Terms of Use and our Privacy Policy.

 

Products

Product information is available on the Site and provided in accordance with Local Laws.

We take all reasonable professional measures to ensure that all details, descriptions, and images of products appearing on the Site are correct at the time the relevant information is entered into the system. However, to the extent permitted by applicable law, we do not guarantee that such details, descriptions, and images of products are absolutely accurate, complete, reliable, up-to-date, or error-free.

The products described on the Site, as well as the corresponding samples that we may provide to the customer, are reserved for personal use only. Customers may not sell or resell any of these products or samples. We reserve the right, with or without notice, to cancel or reduce the quantity of products or samples provided to the customer if such quantity is contrary to the provisions of these General Sales Conditions.

 

Price

All prices indicated for products available on the Site include VAT at the current applicable rate and are expressed in the local currency. Delivery charges are indicated to the customer before finalizing the order. They are added to the price of the products and indicated separately on the order form. For more information, also see the Delivery section of the Site.

We regularly check that the prices displayed on the Site are correct, but we cannot guarantee the absence of errors. In the event of a manifest error in the price of a product, we will offer the customer the opportunity to purchase the product at the correct price or to cancel their order.

Prices are subject to change from time to time. The applicable prices are the prices published on the Site on the date the customer places the order.

 

Order

Customers may freely browse the Site without being required to place an order. If the customer chooses to place an order, they will be guided through the process by a series of simple instructions provided on the Site or by Customer Service.

To place an order, the customer must enter the quantity of product they wish to purchase. Limitations on the number of orders and/or items per order may apply.

The customer then clicks on "Buy" to add the selected product in the desired quantity to the "Cart." The customer may choose to continue shopping and add other products to their Cart, or proceed to payment by clicking on the "Proceed to checkout" button. At any time during their shopping, the customer can check the products in the Cart by clicking on "My Cart." The customer can remove products from their Cart by clicking on "Remove" next to the selected product in the Cart. If applicable in the Country, the customer can save a product as a favorite by clicking on "Add to favorites." The product will then be moved to the customer's favorites section in "My Account." To access favorites from any computer, the customer must register or log in to their account.

The customer must follow the instructions on the screen to validate their payment on the Site. The customer can correct any errors in the data they have entered, modify the contents of the Cart by adding or removing products, or cancel the entire order before it is sent. Before placing an order on the Site, the customer has the opportunity to review and modify all details, including billing and shipping information, before confirming their order. In addition, the customer must acknowledge and confirm that they have read all instructions provided during the ordering process and that they accept these General Sales Conditions by confirming action on the Site (e.g., by checking a box). The customer finalizes their order for products on the Site by clicking on the "Submit and pay" button at the end of the ordering process.

Once the order is submitted, a confirmation page will be displayed, and the customer will quickly receive an email confirming receipt of their order. In accordance with the provisions of Local Laws, the email confirming receipt of the order contains a summary of the General Sales Conditions, information on the main characteristics of the purchased products, detailed information on the price and means of payment, information on delivery charges, information on the conditions and means of exercising the right of withdrawal, the address to which to send claims, information on support services, and on existing commercial warranties.

For any questions or issues during ordering, or for any questions regarding a previous order, the customer can contact us by email at contact@ateliermignonparis.com for faster service, customers are encouraged to provide their order number.

 

Promotional Codes

If promotional codes are applicable in the Country, customers must enter their code in the "Promotional Code" box during payment on the Site to use it. Promotional codes are case sensitive and must be entered exactly as they appear.

When a promotional code is accepted, the offer is displayed in the "Order Review" section.

Only one promotional code can be used per order.


Payment

Customers can pay for products by credit card. The following credit cards are accepted for payments on the Site and are detailed at the time of payment.

To ensure customer security, the billing name and address must match those on the credit card used for payment. We reserve the right to cancel any order that does not meet this criterion.

All credit card holders are subject to validation and authorization checks by the credit card issuer. If a customer's payment card issuer refuses or does not authorize, for any reason, payment, either before or after payment, we cannot be held responsible for any delay or failure to deliver.

The applicable purchase price at that time will be charged to your payment card. By placing an order on the Site, you expressly authorize Us to perform this credit card validation check and, for legitimate purposes only and to the extent permitted by applicable regulations, to transmit or obtain information (including updated information) about you or from third parties, including, but not limited to, your payment card number, to confirm your identity, validate your payment card, obtain authorization for the payment card, and authorize individual purchase transactions.

 

Order Processing

Products are generally dispatched within 2 business days. For information regarding delivery, customers can contact us by email at the following address: contact@ateliermignonparis.com.

Customers can check the status of their most recent orders by visiting the Orders page in My Account on the Site. This is the quickest and easiest way to get the latest information about orders.

When the customer clicks on the Orders page, they are prompted to log in with their email address and password. A summary page of orders then provides detailed information about current and past orders. Once an order is shipped, the corresponding tracking number is displayed, if applicable. Customers can track the delivery status of the order through our carrier by clicking on "Shipped Orders" under the Orders heading. Some carriers may take up to 24 business hours after shipment to display tracking information.

Orders are sometimes canceled in whole or in part by our systems for various reasons, including:

Unavailable item(s), even though we make every effort to ensure that unavailable items are displayed as such on the Site; Unable to process payment information; Unable to deliver to the provided address; Duplicate order placed; Cancellation at customer request.

If an order is canceled, the customer receives an email explaining the reason for the cancellation. Customers are not charged for canceled orders. If the customer wishes to place a new order or has questions regarding a canceled order, they can contact us by email at the following address: contact@ateliermignonparis.com.

 

Delivery

Orders are shipped only on business days. Business days are Monday through Friday, excluding holidays. Orders placed on Saturday and Sunday will be processed the next business day.

Delivery charges are the responsibility of the customer and are indicated separately on the order form and the delivery note. No shipping charges are applied for purchases exceeding the amount we display on the site.

In accordance with Local Laws, products are delivered within 14 business days from the day following the day the order is placed by the customer, unless we inform the customer, including by email, within the same period, of the unavailability of the ordered products, including temporary unavailability.

 

Right of Withdrawal

We undertake to provide customers with the highest quality products possible. However, if the customer believes that the products received do not meet their expectations and in accordance with Local Laws, the customer has the right to cancel the contract without giving a reason within fourteen (14) business days from the date the products were received.

The withdrawal period is fourteen (14) days from the date you - or a third party on your behalf who is not the carrier - received the products. With regard to contracts for multiple products delivered separately, the cancellation period is thirty days from the date you - or a third party on your behalf who is not the carrier - received the last product in the order.

However, this right of withdrawal does not apply to personalized products, except in the case of defects in the products or incomplete or incorrect delivery. If a personalized product is delivered damaged or is found to be defective, the customer must contact us immediately at the following coordinates: contact@ateliermignonparis.com.

The intention of the customer to exercise their right of cancellation can be communicated to us by email at the address contact@ateliermignonparis.com attaching the details of the order, including the order number and description of the products returned. You can also, without obligation, use the withdrawal form provided in Annex I to these General Sales Conditions. To meet the cancellation deadline, it is sufficient to send us your decision to exercise your right of cancellation before the expiration date of the cancellation period. The customer will find in the package of the order a delivery note containing the details of the order as well as information on our return process. If the products listed on the delivery note do not match the products included in your delivery, the customer must immediately inform us by sending an email to the address contact@ateliermignonparis.com.

If you wish to return an item purchased on the THE PINK ARTIST website, please follow the steps below:

Contact us at contact@ateliermignonparis.com stating your order number and your decision to return the products to receive a return shipping label. List the products you wish to return on the delivery note and fill in the necessary details in the table. Carefully pack the products you wish to return and be sure to add the delivery note before carefully closing the package. Affix the shipping label to your package and drop it off at the nearest post office or with one of the carriers listed on the provided shipping label. Refer to our General Sales Conditions for more information on returns.

If the customer returns products for reasons other than defects in the products or incomplete or incorrect delivery, they must arrange and pay for the return of the products.

When exercising the right of withdrawal, we undertake to refund the customer the full price of the products within fourteen (14) days from the date of receipt of the cancellation, to the extent that the products are returned unused and undamaged, as quickly as possible and no later than 14 days from the date of receipt of your cancellation declaration, and where we receive proof of return before the refund. We may refuse to make a refund until we have received the returned products or you have provided proof of return of the products, whichever occurs first. Refunds are made only to the credit card originally used. We send an email to inform the customer once the refund has been made.

It is strongly recommended to return the package via a tracked shipping service (requiring a signature upon receipt).

The aforementioned provisions apply only to online purchases. Products purchased in-store are subject to the store's return policy. Returns or exchanges of products purchased at an THE PINK ARTIST store cannot be made for products purchased on the THE PINK ARTIST website. Returns or exchanges of products purchased online are not accepted at THE PINK ARTIST stores.

 

Non-conformity

In case of non-conformity of the products according to Local Laws, the legal warranties established by Local Laws apply. The customer has the right to request the products be brought into conformity free of charge through repair or replacement. If either of the aforementioned solutions fails, the customer may request an appropriate reduction in the price of the products or cancellation of the contract. The customer waives these rights if they do not inform us of the non-conformity within a reasonable time after discovering the non-conformity. We can only be held liable if the non-conformity appears within three (3) years from the delivery of the products.

 

Applicable Law and Jurisdiction

These General Sales Conditions are governed by and must be interpreted in accordance with French law.

Any dispute arising from the formation, interpretation, or execution of this contract shall be submitted to the competent French courts or any other competent judicial authority.
